Legal
Terms of use.
Draft for legal review. Items in [brackets] are still to be confirmed.
The short version
- Chi is coaching and education. It is not therapy, counselling, medical care or a crisis service.
- Memberships renew until you cancel, and you can cancel or pause any time from Manage my membership.
- Live courses run live once. Recordings join the member library, and there is no promise a course will be taught live again.
- Be kind in the community, and keep what others share there private.
- Nothing in these terms limits your rights under the Australian Consumer Law.
Who we are
This website, the Chi membership and the Chi Dashboard are run by Jeremy Cole, trading as Chi Coaching [business structure to be confirmed], ABN [ABN to be added]. In these terms, "we", "us" and "Chi" mean Chi Coaching, and "you" means the person using the site or buying from us. You can reach us at jc@chi.net.au.
These terms apply when you use this website, join the membership, use the Chi Dashboard, take part in a live course, workshop, catch-up or Q&A, buy or redeem a gift, or apply for private coaching or a retreat. Our privacy policy and cancellation and refunds policy form part of these terms.
Coaching, not therapy
Chi offers coaching, education and self-development tools. We are not a medical, psychological, counselling or emergency service, and nothing we offer is a diagnosis or treatment of any condition. The 8 Areas Assessment and other tools in the Chi Dashboard are reflective exercises, not clinical assessments.
Somatic and shadow work can bring up strong feelings. Go gently, pause whenever you need to, and look after your own safety. If you have a physical or mental health condition, please talk with your GP or a registered health professional before and alongside this work.
If you are in crisis, call Lifeline on 13 11 14 (24 hours) or text 0477 13 11 14. In an emergency, call 000.
You remain responsible for your own choices and wellbeing, and for any decisions you make after using Chi.
Who can join
You need to be at least [18] years old to join the membership, buy from us or apply for coaching or a retreat. Please give accurate details, and keep your email address up to date so we can reach you about your membership.
The membership
- Levels. Bronze, Silver and Gold give different levels of access, as described on the membership page at the time you join. Every level includes the Chi Dashboard.
- Payment. Memberships are paid in advance, monthly or yearly, in Australian dollars. Payments are processed by Stripe; we never see or store your full card number.
- GST. [While Chi is not registered for GST, no GST is charged. If that changes, prices will show whether GST is included.]
- Renewal. Your membership renews automatically at the end of each period until you cancel. We email you [14] days before each yearly renewal.
- Cancelling, pausing and changing level. You can do all of these any time from Manage my membership. How refunds work is set out in our cancellation and refunds policy.
- Price changes. We may change prices for future periods. We will give you at least [30] days' notice by email, and you can cancel before the new price applies. Founding members keep their price for as long as their membership continues, including while paused.
- One person per membership. Your membership and your Dashboard sign-in are for you alone. Please don't share them.
The Chi Dashboard
When you join, we create your Chi Dashboard account and record your level. Your Dashboard account is hosted by our provider, Supabase. Please keep your sign-in details private and tell us straight away if you think someone else has used them.
The Dashboard grows over time. We may add, change or retire apps and features. Anything marked "coming soon" is planned, not promised for a particular date. If we remove something that was a main part of your level, we will tell you and you can cancel without losing the period you've paid for, or ask us about a pro-rata refund.
Live courses, workshops, catch-ups and Q&As
- Live courses run live once, on the dates shown when you join. Afterwards, the recordings join the member library for Gold members. There is no promise that a course will be taught live again.
- Every session time on the site shows its time zone. It's up to you to check the time where you live.
- Places are sometimes limited. Places-left counts on the site are kept up to date by hand and are a guide, not a guarantee.
- If we need to cancel or move a course or workshop, you can choose a full refund or a place on the new dates.
- Sessions may be recorded for members. If you'd rather not appear in a recording, keep your camera off and use the chat, or tell us beforehand.
The community
The community works because people feel safe in it. When you take part in catch-ups, Q&As, workshops or member spaces, please:
- be kind, and speak from your own experience;
- keep what others share private, and never record, screenshot or repost other members;
- don't give medical, psychological, legal or financial advice to other members, or sell to them;
- don't post anything unlawful, hateful, harassing or sexually explicit.
We may remove posts, or pause or end a membership, if someone puts others at risk or seriously or repeatedly breaks these guidelines. If we end a membership for this reason, we will refund any unused prepaid period unless the law allows otherwise.
Gifts
A gift membership is paid once, for the months chosen. A gift code can be redeemed within three years of purchase. Once redeemed, it runs for the months bought and then ends; the person who redeems it is never charged unless they choose to continue. Gift refunds are covered in our cancellation and refunds policy.
Private coaching and retreats
Private coaching and retreats are offered by application only. Applying doesn't guarantee a place. If you are offered a place, we will send you a separate agreement setting out what's included, the price, the schedule and how cancellations work, and that agreement will apply alongside these terms.
For retreats, you are responsible for your own travel, visas, travel insurance and any health requirements. [Retreat-specific terms, including health disclosures and activity risks, to be confirmed.]
The free 8 Areas Assessment
The assessment is a reflective tool for your own insight. Your results describe your answers on the day you took it; they are not a diagnosis or a prediction. See our privacy policy for how answers are handled.
Our content
Everything in the membership, the Dashboard, courses, workshops and on this site, including text, recordings, worksheets, designs and the Chi name and mark, belongs to Chi Coaching or the people who licensed it to us. You may use it for your own personal development. Please don't copy, share, sell, teach from or publish it, or use it to train software, without our written permission.
Anything you post in the community stays yours. You give us permission to show it to other members in the place you posted it, and to keep it there unless you delete it.
Using the site
Please don't try to get around access controls, interfere with the site or the Dashboard, scrape them, or use them for anything unlawful.
Your rights under Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those rights.
Apart from those rights, and to the extent the law allows: we provide Chi with care and skill, but we can't promise particular results from coaching or self-development; our total liability to you for any claim is limited to supplying the service again or paying the cost of having it supplied again; and we are not liable for indirect or consequential loss. [Limitation wording to be confirmed by a lawyer.]
Changes to these terms
We may update these terms from time to time. If a change materially affects a current membership, we will tell you by email at least [30] days before it applies, and you can cancel before then.
Law and disputes
These terms are governed by the law of [State or Territory], Australia. If something goes wrong, please contact us first at jc@chi.net.au, and we'll do our best to put it right.
